The Purpose of this Privacy Policy

This Privacy Policy is designed to protect the privacy, secrecy, safety, unity, and integrity of the TransformMate [App] mobile application’s users’ personal data in accordance with the best international standards and practices.

The provisions of this Privacy Policy shall apply to the processing of Your personal data while using Application, whether totally or partially, through automatically operated electronic systems or other means.

We ensure your personal data is kept securely and protected from any breach, infringement, illegal or unauthorized processing. The Company establishes technical and organizational measures and procedures in accordance with the latest data protection legislation of the United Arab Emirates and Dubai Integrated Economic Zones Authority.

Definitions

As used in this Privacy Policy, the following terms shall have the following meanings:

• The Company, We, Us: Fizikl IQ — FZCO — a company, including any of its employees, representatives, or agents, which provides remote informational support and familiarization with available training programs for natural persons («Service»). For the purpose of this Privacy Policy, the Company is the Data Controller.
• Client: any natural person, who accesses or uses Application and Service.
• Application: TransformMate [App] mobile application.
• Service: services being provided by giving access to Application, as well as the functionalities of Application itself.
• Device: a mobile phone or any other device through which a Client can access Application and Service.
• Personal Data: any information relating to an identified or identifiable natural person («Data Subject»); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
• Data Subject, You: any Client whose Personal Data are stored and processed under this Privacy Policy.
• Processing: any operation or set of operations which is performed on Personal Data or on sets of Personal Data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.
• Data Controller: the Company as the legal person which alone or jointly with others determines the purposes and means of the processing of Personal Data.
• Data Processor: means any natural or legal person who processes Personal Data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.
• Counterparty: a third-party natural or legal person hired by the Company for the purposes of Service provision, or to perform related services, including analysis of the Service usage.
• Cookies: small text files that are placed on Your mobile device or any other device by a website or mobile application, containing the details of Your browsing history on that website, mobile application, etc.

Purposes of Personal Data processing

The Company may process or ensure of processing of Personal Data for the following purposes:

• To provide and maintain our Service, including provision of informational consultations, Your familiarization with available training programs, provision of pre-designed and/or customized for your personal characteristics and requirements training programs.
• To manage Your Account: to manage Your registration as a user of the Service. The Personal Data You provide can give You access to different functionalities of the Service that are available to You as a registered user.
• To contact You: To contact You by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application’s push notifications regarding updates or informative communications related to the functionalities, products or contracted services, including the security updates, when necessary or reasonable for their implementation.
• To provide You with: news, special offers and general information about other goods, services, and events which we offer that are similar to those that you have already purchased or enquired about unless You have opted not to receive such information.
• To manage Your requests: to attend and manage Your requests to Us.
• For other purposes: We may use Your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Service, products, services, marketing and your experience.

We may share Your personal information in the following situations:

• With Counterparties: We may share Your personal information with our Counterparties to provide the Service, to perform related services, to monitor or analyze the use of our Service (analytical services), to process Your payments (payment services), or to contact You (i.a., email marketing).
• With affiliates or agents: We may share Your information with Our affiliates or agents, in which case we will require those affiliates and agents to honor this Privacy Policy. Affiliates include Our parent company and any other subsidiaries, joint venture partners or other companies that We control or that are under common control with Us.
• With other users: when You share personal information or otherwise interact in the public areas with other users, such information may be viewed by all users and may be publicly distributed outside.

Types of Data Collected

Personal Data

The Company processes or ensures of processing of the following types of Personal Data:

• Individual and contact details: name, address, email, telephone number, date and place of birth, gender, etc.
• Your physical health, medical condition and history.
• Your photos and videos.
• Other identifiers: IP address, cookies, Web Beacons, etc.

Usage Data

Usage Data is collected automatically when using the Service.

Usage Data may include information such as Your Device’s Internet Protocol address (e.g., IP address), the pages of our Service that You visit, the time and date of Your visit, Your geolocation, the time spent on those pages, unique device identifiers and other diagnostic data.

When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, unique device identifiers and other diagnostic data.

We may also collect information that Your browser sends whenever You visit our Service or when You access the Service by or through a mobile device.

Cookies can be «Persistent» or «Session» Cookies. Persistent Cookies remain on Your personal mobile device when You go offline, while Session Cookies are deleted as soon as You close Your Application or web browser.

Purpose: These Cookies are used to track information about traffic to the Application and how users use the Application. The sources from which the Company collects Personal Data may include:

• our Clients,
• our Counterparties,
• other third parties,
• publicly available registers or sources of information, etc.

7. Transfer of your Personal Data

Your information, including Personal Data, is processed at the Company’s operating offices, Data Processors’ operating offices, and in any other places where the parties involved in the processing are located. It means that this information may be stored and maintained on — and transferred to — computers located outside of Your province, country, or other governmental jurisdiction where the data protection laws may differ than those of Your jurisdiction.

Your information may be transferred to the country or territory which has adequate level of data protection determined by the UAE authorities and countries that the UAE is entered to bilateral or multilateral agreements related to Personal Data Protection.

In case the country or territory is not deemed by the UAE authorities as the country or territory with adequate level of data protection, but in order to provide You with the services by the Company there is a necessity of such cross-border transfer, Your information may be transferred to those countries or territories under the Company’s obligation to ensure the level of data protection set out by the UAE legislation. Your consent to this Privacy Policy followed by Your submission of such information represents Your agreement to aforementioned transfers.

The Company will take all steps reasonably necessary to ensure that Your Personal Data is treated securely and in accordance with this Privacy Policy and no transfer of Your Personal Data will take place to an organization or a country unless there is an adequate level of personal data protection, or appropriate safeguards are implemented.

Business Transactions
If the Company is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.

The Company shall ensure that the processing of Personal Data is limited to its intended purpose(s).

The Company shall apply appropriate measures, both when defining the means of processing and during the processing itself, in order to comply with the applicable data protection legislation, and provisions of this Privacy Policy.

In case of appointment of Processor(s), the Company shall ensure that such Processor(s) provides sufficient guaranties to apply technical and organizational measures in a manner that ensures that the processing meets the provisions of this Privacy Policy, as well as requirements, rules, and principles stipulated in the applicable personal data protection legislation.

The Company shall not take any action that would disclose the Personal Data or the results of processing, except in cases permitted by law.

The Company shall comply with other obligations arising from this Privacy Policy or the applicable personal data protection legislation.

The security of Your Personal Data is important to Us, but remember that no method of transmission via the Internet, or method of electronic storage is 100 percent secure. While We strive to use commercially acceptable means to protect Your Personal Data, We cannot guarantee its absolute security.

10. Detailed Information on the Processing of Your Personal Data

Counterparties have access to your Personal Data only to perform their tasks on our behalf and are obligated not to disclose or use it for any other purpose. These third-party vendors collect, store, use, process, and transfer information about Your activity on Our Service in accordance with their Privacy Policies in the following situations:

We may use third-party Counterparties to monitor and analyze the use of our Service. Such as:

Email Marketing

We may use Your Personal Data to contact You with newsletters, marketing or promotional materials and other information that may be of interest to You. You may opt-out of receiving any, or all, of these communications from Us by following the unsubscribe link or instructions provided in any email We send, or by contacting Us. Payments

We may provide paid products and/or services within the Service. In that case, we may use third-party services for payment processing (e.g., payment processors).

We will not store or collect Your payment card details. That information is provided directly to Our third-party payment processors whose use of Your personal information is governed by their Privacy Policies. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information. Main payment processors that we use are:

The Client who is the Data Subject confirms that his/her consent to Personal Data processing is given in a clear, simple and unambiguous manner.

If the Client provides (disclose) Personal Data of another Data Subject, this Client guarantees that he/she has the prior consent of the Data Subject for such disclosure.

Data Subject may, at any time, withdraw his/her consent to the processing of his/her Personal Data. Such withdrawal shall not affect the legality and lawfulness of the processing made based on the consent given prior to such withdrawal.

11. GDPR Privacy

Legal Basis for Processing Personal Data under GDPR

We may process Personal Data under the following conditions:

• Consent: You have given Your consent for processing Personal Data for one or more specific purposes.
• Performance of a contract: Provision of Personal Data is necessary for the performance of an agreement with You and/or for any pre-contractual obligations thereof.
